Compliance
Benefits compliance, handled and on time.
CBA provides compliance solutions throughout the year. We track what is due, assist in preparation, and help keep everything on schedule, so it does not fall on your HR team.
Compliance fails quietly. There is no alarm when a filing is missed or a notice goes unsent. You find out later, in a penalty, an audit letter, or a gap in someone's coverage. And most employers do not have a clear, full picture of everything they are actually responsible for.
We keep track of all of it through the year and make sure it is handled for you.
The compliance year
Every obligation, mapped across the year
We keep each of these on the calendar for your plan, so a deadline never passes with no one watching it.
What we keep on track
The named obligations
- ACA reporting (1094-C / 1095-C) Early in the year
Forms furnished to employees and filed with the IRS for the prior year.
- Section 125 Plan setup and ongoing
The premium-only / cafeteria plan document that lets deductions run pre-tax, kept current.
- ERISA (wrap document) Maintained year-round
Plan documents and required participant disclosures kept in order.
- Form 5500 Midyear
Annual return filed for applicable plans for the prior plan year.
- COBRA Triggered by events
Notices and administration handled as qualifying events occur, all year long.
These are the big ones. In all, an employer's benefits compliance can run to around 40 separate requirements. CBA coordinates the full set for your plan, so what applies to you is tracked and handled, not left for your team to chase.
Which of these apply depends on your size, your plans, and how they are funded. We tell you what is required for you, and make sure it is handled on the schedule it is due.
How we keep it handled

We track it
During our annual compliance review, we discuss and plan key compliance items relative to you and your team to stay ahead of deadlines.
We file it
We make sure that a plan is in place to meet filing deadlines and keep required notices on schedule so that the work gets done, not just flagged.
We keep your records in order
Plan documents and disclosures stay current, so you are ready if you are ever asked for them.
What you stop worrying about
The quiet failures that catch employers off guard
- A reporting deadline passing with no one watching it.
- A COBRA notice that should have gone out and did not.
- Plan documents that are out of date when you are asked for them.
- Penalties for a filing you did not know was yours to make.
Common questions
Common questions
- Who files our 1094-C and 1095-C forms?
- CBA works with each employer to determine the best method of filing for accuracy and simplicity. Sometimes this may be handled best by a payroll system, while other times it may be better to have a more customized solution so that filing does not fall on your HR team.
- What benefits compliance is an employer actually responsible for?
- More than most realize. The big ones are ACA reporting (1094-C/1095-C), COBRA, Section 125, ERISA plan documents, and Form 5500, but the full picture can run to around 40 separate requirements once you add items like SBCs, PCORI, RxDC reporting, gag clause attestation, Medicare Part D notices, and nondiscrimination testing. CBA coordinates the set that applies to you and keeps it on schedule.
- What happens if we miss an ACA or 5500 deadline?
- Missed filings can carry per-return and per-day penalties that add up quickly. The risk is that these deadlines pass quietly, with no one watching. CBA tracks them on your behalf so they are met before they become a problem.
- Does my broker handle COBRA, or do I?
- With most brokers, COBRA falls back on you. CBA creates integrated solutions to make sure COBRA notices and administration are handled in real time, so it is taken care of as events occur.
Make sure nothing is slipping through.
A benefits review includes a plain look at the compliance you are responsible for, and what is currently being handled. A review costs nothing.
